Traffic Offenders Intervention Program (TOIP)

This education program is designed to reduce the likelihood of people committing additional alcohol or safety related traffic offences.

In some cases the court will refer a person to the program if they have committed a serious traffic offence including street racing, drink and/or drug driving, excessive speed or drive while disqualified.

CASE STUDY 1

Our client had been breathalysed with a blood alcohol reading of just over the legal limit. At the hearing we called evidence from a pharmacologist who provided expert evidence outlining that at the time of driving our client was not over the legal limit.

The magistrate having accepted the evidence dismissed the charge against our client. This meant that our client retained his driver’s licence and kept his reputation in tact.

CASE STUDY 2​

Our client had been arrested of an offence of driving with a mid range concentration of alcohol. His driver’s licence was very important to his ability to continue with his employment.

Following a very thorough and spirited defence, and while the offence was proven, the magistrate proceeded without recording a conviction.

This meant our client’s driver’s licence was not suspended and most importantly he retained his employment.
